Iowa Chapter of ABOTA Welcomes Shuck as 2015 President

The American Board of Trial Advocates (ABOTA) – Iowa Chapter welcomes Daniel B. Shuck as the 2015 President. During his presidency, Mr. Shuck hopes to focus on civility and ethics in trial practice and to offer the Civility Matters presentation at the University of Iowa College of Law, Drake University Law School, and the Iowa Bar Association Annual Meeting. Mr. Shuck also hopes to see the Iowa Chapter propose changes in the swearing-in of new attorneys which will include language regarding civility.

Defense Verdict Entered in U.S. District Court (Nebraska)

Trial commenced before Magistrate Judge Gossett in the United State District Court, District of Nebraska on May 20, 2014. After four days of trial and two days of deliberations, the jury returned a verdict in favor of Defendant, Rasmussen Mechanical, finding that the Plaintiff had not met their burden of proof in this matter.

Plaintiff was the insurer for Nebraska Methodist Health Systems, Inc., in Omaha, Nebraska. They had a multi-boiler system that helped to heat the hospital and on November 23, 2011, boiler #1 in the system failed. Plaintiff alleged that an oil filter should have been installed in this system by Rasmussen Mechanical, prior to the failure.

Shuck Earns ABOTA Diplomate Designation

We are honored to announce that in April 2014 Mr. Shuck achieved this extraordinary distinction, having tried 68 civil jury trials to a jury verdict or hung jury as lead counsel, and 13 felony criminal trials to a jury verdict or hung jury as lead counsel.

Diplomate is ABOTA’s highest rank. An ABOTA Diplomate shall have at least twelve years of active experience as a trial lawyer and as a member of the Bar of the state, province, district or territory in which he or she practices, shall have held the rank of Advocate for a minimum of three years and shall have tried a minimum of 100 civil jury trials to a jury verdict or hung jury as associate counsel or, in the alternative, shall have tried fifty 50 civil jury trials to a jury verdict or hung jury as lead counsel.

Shuck Presents “Civility Matters” at University of Iowa College of Law

The Iowa Chapter of ABOTA is initiating an annual civility institute at the Iowa and Drake law schools. On April 18, 2014, Iowa ABOTA President, Steve Doohen, and Vice President, Daniel Shuck, traveled to Iowa City to make a presentation on civility to the Iowa law students. Also joining Attorneys Doohen and Shuck was U.S. Magistrate Judge, Jon Scoles. This fall another presentation will be given to the law students at Drake University Law School in Des Moines, Iowa.

Shuck Represents Iowa Chapter at ABOTA National Leadership Conference & Board Meeting

The ABOTA Leadership Conference and Board Meeting was held at the Ritz-Carlton, Laguna Niguel in Dana Point, California, January 23 through January 25, 2014. Attorney Shuck represented the Iowa ABOTA Chapter and had the opportunity to work with Chapter Leaders from around the nation to discuss various topics that effect ABOTA at the Chapter level.

Shuck Named Vice-President of Iowa Chapter of ABOTA

In January 2014, Attorney Daniel Shuck was nominated to serve as Vice-President of the Iowa Chapter of the American Board of Trial Advocates (ABOTA) for 2014. ABOTA membership is by invitation, only, and is extended only to attorneys with extensive trial experience, high personal character and honorable reputation.

Jury Finds Sprinkler Company Was Not Responsible for Failure of System

Trial in the matter of Miller & IMT Insurance v. Building Sprinkler, commenced before Judge Susan Sabers on October 8, 2013. The Millers owned a Super 8 Motel and IMT was their insurer. Shuck Law Firm client, Building Sprinkler, performed annual inspections of the Super 8 sprinkler system and made recommendations for equipment that would prevent a malfunction of the dry sprinkler system. After a particularly cold month, the hotel’s dry sprinkler system failed and caused the sprinkler pipes to burst.

Plaintiff alleged that Building Sprinkler failed to properly maintain the system and make necessary repairs. After four days of trial, the jury found that Building Sprinkler was not negligent and not responsible for the pipes bursting. The jury granted Building Sprinkler a defense verdict.

Expansion of Firm

Since opening in April 2009, the Shuck Law Firm has been located in Suite 205 at the U.S. Bank Building 5th & Pierce Street, Sioux City, IA. We are pleased to announce that we have expanded our office space to include an additional office and a second conference room. We are confident that this will allow the members of the firm to have an even more enjoyable working experience, and the clients of the firm access to this state of the art facility. Along with the expansion wireless internet access was installed to accommodate clients, opposing counsel and members of the firm. In addition, we added wireless conferencing to our conference rooms to facilitate depositions, mediations and arbitrations. It is our fondest hope and desire that this will enhance the experience of working with the Shuck Law Firm. Shuck Law Firm accepts requests for accomodations from out-of-town counsel needing space in the Siouxland area, please feel free to contact us in that regard.

Shuck Honored as Inductee into ABOTA

On October 14, 2010 at the Wakonda Club in Des Moines, Iowa, Dan Shuck was honored as an inductee into the American Board of Trial Advocates.  Since its inception in 1958, ABOTA's primary mission has been the preservation of the civil jury trial right guaranteed by the 7th Amendment to the U.S. Constitution.

Membership in ABOTA is by invitation only.  Invitation is extended only to attorneys of high personal character and honorable reputation and, importantly, only to those with demonstrated experience in trying cases to a jury.  Consequently, ABOTA's members are some of the best lawyers in your community, state and our nation.
